- Under the FLSA, an employee’s regular rate of pay is the sum of all remuneration for employment (barring certain statutory exclusions) divided by total hours worked in a workweek.
- The state law employs a different calculation that depends on whether the employee is paid on an hourly or a salary basis:
- For any hours worked by an employee more than 40 hours in any one workweek, an employer shall pay such employee an overtime premium at a rate not less than one and one-half times the employee's regular rate, pursuant to 29 U.S.C. § 207.
- An employee's regular rate shall be calculated as follows:
- For employees paid on an hourly basis, the regular rate is the hourly rate of pay plus any other non-overtime wages paid or allocated to that workweek, excluding any amounts that are excluded from the regular rate by the federal Fair Labor Standards Act, 29 U.S.C. § 201 et seq., and its implementing regulations, divided by the total number of hours worked in that workweek.
The Calculation Example
The hourly portion includes the transaction type Commission in its calculation of the overtime rate.
OT factor is calculated as 0.5 * (((total hours worked * reg rate) + non-discretionary bonus pays + commission pay) / total hours worked).
Example: An employee works 50 hours at $25/hr and is paid $500 of commission.
The result should be:
40 units of Reg with a rate of $25 = $1000
10 units of OT with a rate of $42.5 = $425
1 unit of Commission with a rate of $500
Total of $1925
OT rate calculation: ((50 * 25) + 500) / 50 = 35 * 0.5 = 17.5 + 25 = $42.50
